break lease foreclosure
Landlord is loosing house to foreclosure. Moved out this month and he did not do a deposit return walktrhough?
So bascially the landlord I had for a year was a mess. Never did repairs or anything like that. Then he tried to sell the home very quick for no apparent reason even though we still had 3 months left on the lease that was for 1 year, so we went to eviction court and won of course. we werent breaking the lease. now that we are moving out, he said was going to do the walkthrough which is required by law no earlier than 2 weeks before move out. It turns out the landlord is in so much debt, the home is going into foreclosure and was auctioned today. I moved out and have paid till the end of the month. He isnt returing calls for the deposit and also was interested in getting the rest of the money for the month since the house was auctioned today. Would i just have to go to small claims with the landlord or does the person who wins the auction just pay us off or how does this work? Sorry its so long.
You are kinda screwed. Court is one way to solve it, but it will cost you money. The person buying it has no obligation to pay you. I would be very persistant with your ex landlord and when you do talk to him, ly and say that you have spoken with a laywer(say its a family member so he thinks it wont cost you anything) and your laywer said that you would give the landlord the benifit of the doubt to settle the debt before pursuing legal action.
