Can I just walk away from my home without a foreclosure on my credit?
I filed for chapter 7 bankruptcy in 10/05. I was discharged in 03/06. I filed under the old bankruptcy laws. Well apperentely my attourney who is no longer practicing law never had me fill out the redemption paperwork to keep my home. I have never missed a payment even during the bankruptcy with all good intentions to keep my home. Well last month I went to get qualified for a new home and sell the current home. I found out that Wells Fargo was not reporting to my credit bearau!!! NIGHTMARE!! Because they are not reporting I do not have the credit to buy a new home. I called Wells Fargo and they will not help me they said all I can do is refinance to get the home back in my name. I now am so frustrated I just want to give it back and go on. Can I legally do that since I did not redeem the residence during my bankruptcy?

You need to find a good lawyer in your area immediately to sort this out. You might have a case for malpractice against the prior attorney, but this is difficult to pursue.
Bankruptcies remain on your credit report for ten years after discharge, so basically your credit is fouled for a decade. Credit markets are very tight right now, and lenders are limiting loans to the highest-rated borrowers so your ability to get a new mortgage or refinance is very, very slim. “Walking away” from the mess will foul your credit rating further and could come back to haunt you.
