Why home owners don’t fight the foreclosure in court?
Why some people let their house go without a fight? Especially when
you can prove that your tried to keep it from foreclosure. Is it because
the judge always go favor of the bank?
Because they don’t know their options and they don’t hire an attorney. There are people out there who call themselves “foreclosure consultants” who are often investors, who can help in some cases. People are afraid and unsure of what to do and often get “cooked in a squat” by not taking any action or being fearful of being taken advantage of. The fact that some of the people calling themselves “foreclosure consultants” are crooks doesn’t help.
But, I have known investors/foreclosure consultants who successfully argued to stop a homeowner’s foreclosure in court. A careful review of documents from the original closing and other communications with the bank can often reveal that the bank made errors or other mistakes that can call their position into question.
But, most of us don’t know what to look for or don’t take action soon enough out of fear, shame, etc. and so we take it lying down…
