Home Owner’s Association Foreclosure in Texas?

My Home Owner’s Association is attempting to foreclose on my property. But in Texas property Code Chapter 209. 009. states HOA’s cannot foreclose on property if the debt consists of HOA imposed fines or attorney fees.

Quoting from actual foreclosure notice. “Foreclosure Notice with Past Due Maintenance Assessments, Interest, Late Charges, Attorney’s Fees and Costs due and owning in the amount of $xxx.”

Past due maintenance assessments are not fines. So you ought to pay pr lose the house.

The law you refer to means they can’t foreclose for JUST fines and/or attorney fees. They aren’t doing that.
